GENERAL CONDITIONS OF USE AND PURCHASE

FLO RETAIL & SHOES MA (hereinafter Flo) is a limited liability company with a share capital of 37,559,200.00 dirhams, registered in the Casablanca Trade Register under number 385423, having its registered office at B261, Alamal Résidence, Avenue, Abdelmoumen ICE: 001972749000029, IF: 24865149, marketing FLO brand products on Moroccan territory via stores but also via an electronic platform on the address of its e-commerce site www.flo.ma (the Site).

Rules relating to the use of the Site

Access to the Site and its use are subject to the terms and conditions set out in this document on the Site. By using the Site or placing an order on the Site, the user agrees to be bound by all of these conditions of use and purchase (hereinafter the "Terms of Use"), which may be modified by us from time to time.

To this end, we recommend that users of the Site regularly consult this page to be aware of any change that may have been made to the Terms of Use.

Access to the website is provided on a temporary basis and we reserve the right to withdraw and amend services and products without notice.

Flo may at any time restrict access to some or all parts of the Site.

Flo shall have the right, in its sole discretion, to correct, delete or modify the services and products / or any page of the Site at any time and without notice.

By using this Site and placing orders on it, you agree to provide us with all information useful to the processing of orders placed.

Site Membership

Joining the Site, which takes place with the creation of the account and the acceptance of the Terms of Use, marks the start of the user's membership period.

The membership period continues to run for an indefinite period, unless one of the contracting parties decides to close the account or if the Site is temporarily or permanently closed.

Account Security

The user must enter his login information to access his account with his data registered on the Site. It is up to the user to protect the confidentiality of his login information to his account, under penalty of losing his right of use and closing his account.

Commercial messages

The account user consents to all commercial electronic messages sent to it by Flo. The user has the right to stop receiving electronic messages at any time and without giving any reason. The member must send his request in this regard to Flo by e-mail to the following mail address : zainab.elouahmani@flo.com.tr. or by using the contact details provided on the e-commerce site.

Conditions of purchase on the Site

By placing an order, the user agrees to purchase the product under the terms and conditions provided for in these Terms of Use.

For all orders, the product must be available, and the price of the order must be confirmed. The user agrees not to place false or fraudulent orders.

An order of this nature gives us reason to proceed with its cancellation and, if necessary, inform the competent authorities.
The user declares that he satisfies the condition of the age determined at least at 18 years and that he is legally able to conclude contracts and to commit himself, to place an order online on our Site.

The user is obliged to provide the information requested for the validation of the order and is bound by the veracity of this information. Any error in the information provided that is likely to prevent delivery of the order exempts us from liability and is likely to suspend delivery times due to the impossibility of delivery.

To contract with Flo, the user of the Site must be over 18 years old and have a valid credit or debit card.

Customers who do not have a credit or debit card can take advantage of the cash on delivery option.

Flo reserves the right to refuse any purchase request from the user if it is irregular about the applicable legislation or these Terms of Use.

If your order is accepted, you will be notified by email.

You agree that all information you provide to us when placing an order is accurate and complete, that you are an authorized user of the credit or debit card you used to create the order and that you had sufficient funds to cover the cost of the goods and related charges.

All exhibited prices are subject to change.
In accordance with the provisions of Law no. 31-08 on consumer protection, before validating your order, you have the opportunity to check the details of the proposed order and correct any errors.
When you place an order, you will receive an email confirming receipt of your order by Flo team.
This email is a simple confirmation that your order has been received by us without implying the validation of your order by our team.
This email will be followed by another email confirming the validation of the order, specifying the related details ranging from the characteristics of the product to the detail of the amount to be paid (the price, taxes, delivery costs, etc.).
Only the products listed in the confirmation email sent upon distribution of the products will be included in the agreement.
You will then be informed by email that the order is being sent.
Ordering an item online on the Site implies full acceptance of these Terms of Use.

Price and availability

The prices indicated on the Site include VAT but do not include delivery costs which are added to the total price indicated at the time of validation of the order by the customer.
The total amount includes the price of the product, duties and taxes, delivery service charges and any other additional charges as requested by the customer. The validation of the order implies acceptance of the total amount to be paid in return for the purchased product.
The products appearing on the Site are presumed to be available unless otherwise specified in the section below the product or by the refusal of the validation of the order for lack of availability.
Errors may occur even though we try to ensure that all information, descriptions and prices that appear on the Site are accurate.
If we find that there has been an error in the price of any product you have ordered, we will notify you as soon as possible and give you the option of reconfirming or canceling your order at the correct price. If we cannot reach you, we will treat the order as canceled and the price will be fully refunded to you.
If you cancel the order and you have paid for the products, you will be refunded the full amount you paid.
Prices may change at any time. However, except as otherwise provided above, changes do not affect orders for which we have sent an order confirmation.

Payment

Payment is made either by credit card or cash on delivery.
Cash on delivery is subject to an obligation of confirmation by SMS for the safe transmission of the order to the right person.
Payment will be received in cash by the delivery company at the customer's doorstep.
The choice of payment method belongs to the customer at the time of validation of the order.
As for the method of payment by credit card, you must use one of the credit cards accepted by our Site.
To minimize the risk of unauthorized access, your credit card data will be encrypted.
Once your order has been received, we will require pre-authorization of your card to ensure that you have sufficient funds to complete the transaction. Payment will be debited from your card when your order is dispatched.
When you click on "Authorize payment", you confirm that the credit card belongs to you or that you are the legitimate holder of the electronic voucher or that you are authorized to use the credit card.

Delivery policy

The delivery time is fixed at the time indicated in the order confirmation email without exceeding a period of 30 days from the day of validation of the order by Flo.
The guarantees or declarations concerning the delivery time are limited to Moroccan territory and may be subject to delays for reasons that are beyond our responsibility, such as delays by the company responsible for the delivery or the occurrence of a case force majeure.
The delivery of the product will be accompanied by the delivery of a delivery note, an invoice with the details of your order and the receipt of the product.

The Right of withdrawal

The customer has the right to withdraw without assuming legal liability and without giving any reason, within 7 (seven) days of delivery of the product(s) purchased on our Site.
The product must not be used in order to safeguard the power to exercise the right of withdrawal.
Also, due to their nature, the returns of the goods adapted to the requests or personal requirements of the customer, the protective elements such as the packaging, the adhesive tape, the seal(s), being opened / removed after the delivery and which cannot be returned from the point of view of health and hygiene, as well as goods which are mixed with other products after delivery and which cannot be separated due to their nature, are not accepted.
In the event that the right of withdrawal is exercised:
a) the invoice for the product that has been delivered to the customer or third party at the address notified by him must be sent (together with a return invoice issued by the establishment). Returns of orders invoiced to establishments can only be completed if a RETURN INVOICE is issued;
b) The fields related to the return must be filled in on the invoice;
c) Products to be returned must be delivered free of damage and complete, with box, packaging, label and, where applicable, standard accessories within 7 (seven) days.
The price of the product is refunded to the customer on his bank account, within 15 (fifteen) days following receipt of the product and the aforementioned documents by Flo if the payment was made online by credit card.
If the customer made the payment other than online by credit card, they should contact the customer support service and share their bank account information to get the money refunded.
The account holder must be the customer himself.
In any case, it will be checked whether the person who provided the bank account number is on the "List of prohibited persons" before the refund is made.
If the person is identified on the list, the refund process will be suspended and the customer will be informed of the situation.
If the customer sends a new bank account number in accordance with a name that is not in the list of prohibited persons, the process of refunding the money will start again.
When the product is returned to Flo, the original invoice that was submitted to the customer when the product was delivered must also be returned (to ensure consistency of our accounting records).
An inscription "return invoice" must be written on the invoice which will be returned with the product and must be signed by the customer.
In the event of a reduction in the value of the product or if the return becomes impossible for reasons relating to the fault of the customer, the latter is required to compensate the damage suffered by Flo in proportion to its fault.
The amount of the discount from which the campaign benefits is canceled in the event of a fall below the limit of the campaign organized by the customer due to the exercise of the right of withdrawal.
The prices of the products on the date on which the customer purchased the product concerned are applicable in requests for reimbursement of prices.
In the event of exercise of the right of withdrawal, the returned products must be returned through the carrier that Flo has mandated. In this case the return fees will be paid by the customer.

Privacy Policy

Site users are required to read our privacy policy prior to any use.
During your visit to our Site, you may be asked for personal data.
The personal data collected is processed lawfully and fairly in accordance with the provisions of Law 09/08 relating to the protection of individuals with regard to the processing of personal data.

The information collected on the site processing is intended for the management of Flo's customers, in particular the management of contracts, orders, deliveries as well as the preparation and transmission of invoices in the context of sales online.
The recipients of the data are the company AKİNON INTERNET YATİRİM VE PROJE GELİSTİRME ANONİM SIRKETI, before which the data is hosted on servers located in Germany.
In accordance with Law No. 09-08 promulgated by Dahir 1-09-15 of February 18, 2009, relating to the protection of individuals with regard to the processing of personal data, you have the right to access and rectification of your information, by contacting: Mrs. Zainab EL OUAHMANI by sending her an email to the following address: zainab.elouahmani@flo.com.tr.
You can also, for legitimate reasons, oppose the processing of data concerning you.
This processing has been notified and authorized by the CNDP under the receipt n°…………… and the authorization of the data transfer n°……… .

Intellectual property

The intellectual property rights in all software and content provided on the Site are owned by Flo and are protected by worldwide copyright laws and treaties.

Flo reserves all such rights. Users may store, print and display content provided for personal use only.

The user may not publish, process, distribute or otherwise reproduce or use any content related to a business or commercial organization transmitted to him or on the Site.

Applicable law - Attribution of jurisdiction

These Terms of Use are governed by Moroccan law.
In the event of a dispute over the validity or interpretation of these conditions, exclusive jurisdiction is given to the competent Moroccan courts.
